Many families will be relieved by the innovations introduced by the decree law of 1 April 2021 which provides for schools also open in the red zone, up to sixth grade.
Article 2 of the new law decree 44 of 01/04/2021 provides that, for the period 7 April – 30 April 2021, the performance in the presence of the educational services for children and the school and teaching activities of the kindergarten, primary school and 1st year must be guaranteed throughout the national territory attendance at lower secondary school (first grade).
The Presidents of the Regions and Autonomous Provinces and the Mayors will not be allowed to introduce exceptions to the above, except in cases of exceptional and extraordinary necessity due to the presence of outbreaks or the extremely high risk of spreading the virus or its variants. in the school population.
As for instead the subsequent degrees of education, it is confirmed:
- in the red zone, the carrying out of didactic activities exclusively in remote mode;
- in “yellow zone” and “orange zone”:
- full performance in the presence for the school and teaching activities of the 2nd and 3rd year of attendance of the 1st grade secondary school (middle school);
- carrying out in the presence of 50% to 75% of the student population of 2nd grade secondary schools (high school).
Throughout the national territory, the possibility of carrying out activities in presence is always guaranteed if it is necessary to use laboratories or to maintain an educational relationship that achieves the effective school inclusion of pupils with disabilities and special educational needs, however ensuring the electronic connection with their classmates who are in integrated digital teaching.
The decree law that provides for the vaccination obligation for health personnel has been in force since 1 April.
Article 4 of the new law decree 44 of 01/04/2021 introduces the obligation to undergo free vaccination for the prevention of COVID-19 infection, for health professionals and health professionals who carry out the their activities in public and private health, social, health and social welfare structures, pharmacies, parapharmacies and professional offices.
Vaccination is an essential requirement for the exercise of the aforementioned professions, under penalty of suspension from the right to perform services or tasks that involve interpersonal contacts or involve, in any other form, the risk of spreading the COVID-19 contagion.
In this latter case, in fact, it will be up to the employer to assign the worker, if possible, to tasks, even lower ones, other than those at risk, with the relative treatment. If, on the other hand, this is not possible, the worker will not be due the remuneration for the entire suspension period, or until the vaccination obligation is fulfilled or, failing that, until the completion of the national vaccination plan and in any case no later than 31 December 2021. .
Pursuant to article 3 of the DL, The criminal liability of medical and health personnel in charge of administering the COVID-19 vaccine is also excluded, for crimes of manslaughter and negligent personal injury, if the vaccinations are carried out in compliance with the indications referred to in the marketing authorization provision and the circulars of the Ministry of Health.
