The mandatory paternity leave was also confirmed for 2021 and extended. The newly employed dads will be able to do 10 days of paid absence from work, according to the latest news of the 2021 budget law, which adjusted paternity leave to European laws. The measure is also extended to cases of perinatal death.
Article 4, paragraph 24, letter a), of law no. 92 established compulsory leave and optional leave as an alternative to the mother’s maternity leave, usable by the employed father, also adoptive and foster father, no later than the fifth month of the child’s life.
Paternity leave therefore consists in the compulsory abstention from work of new fathers who are employees.
For calendar year 2021, paternity leave has been extended from seven days to ten days. The protection of the leave itself has been extended, providing for its use also in the case of perinatal death of the child.
The possibility of using one day of optional leave as an alternative to the mother.
The leave is aimed at employed fathers, who are entitled to a daily allowance paid by INPS equal to 100% of their salary.
Employee fathers are entitled to:
- seven days compulsory leave, which can also be taken on a non-continuous basis, for the events of childbirth, adoption or fostering that occurred from 1 January 2020 and until 31 December 2020;
- ten days compulsory leave, which can also be taken on a non-continuous basis, for the events of childbirth, adoption or fostering that occurred from 1 January 2021 and until 31 December 2021.
The dependent father must notify the employer 15 days in advance when he wants to use them. If it coincides with the birth event, the notice is calculated based on the presumed date of birth.
